DECLARATION OF RESTRICTIONS
What is a Declaration of Restrictions?  A declaration of restrictions is a set of obligations placed on the property rights of the owner. These restrictions bind current and future homeowners. A declaration of restrictions is a recorded document (separate from your deed) which outlines the restrictions for an entire development. A declaration of restrictions is generally imposed to protect property values and the quality of life across the community. Click here to read the entire Hills and Dales Declaration of Restrictions.

How is the Declaration of Restrictions Enforced?  Regarding enforcement of the Declaration of Restrictions, please note that the document states "Any lot owner may enforce the restrictions and covenants herein contained by appropriate legal procedure".   In other words, your City Commission as a legislative body does not have enforcement authority. 

                                                                                                               Planning Committee
The Declaration of Restrictions states, “No one shall construct any house, improvement appurtenant thereto, garaging, driveways, landscaping, fencing, or any exterior construction or improvement upon any lot without first receiving written approval thereof from said planning committee.”

The Planning Committee reviews and approves (or does not approve) exterior construction or improvement projects such as those listed above and also swimming pools, gardens and garden enclosures that are visible from the street, storage sheds or other out buildings, any planting or construction in the City’s public roads right-of-way, etc. When in doubt, please ask the Committee! Planning Committee approval is NOT required for routine maintenance and upkeep of roofs and gutters, sidewalks and driveways, fences, landscaping, wood trim and shutters, etc.
